Dealing with construction law issues? Consider legal help

On Behalf of | Apr 1, 2020 | Construction |

Construction is constant in our area of Florida. Yet, unlike the raw materials that go into the physical construction of a building, the business relationships found in the construction industry are typically embodied in contracts and financing agreements. Although these agreements should lay out the obligations and responsibilities of all parties involved, the parties don’t always adhere to these terms.

The result can be a lot of turmoil and legal disputes. As we discussed previously on the blog, a developer’s failure to pay contractors and subcontractors may result in a construction lien being placed on the property, meaning that the property could be sold to satisfy debts. While the debt involved may be relatively small in some cases, in a lot of them there are tens of thousands, if not hundreds of thousands or millions, of dollars at stake, not to mention all of the time and hard work that went into the development of the property.

With so much at stake, those dealing with construction law issues, including construction liens, need to be prepared to aggressively advocate their position, whether through negotiations or in court. As a property owner, there are ways to reduce the risks, including obtaining information from the contractor and obtaining partial releases. Construction companies, on the other hand, need to be prepared to take a matter to court in order to secure the payment to which they are entitled.
